Cooperation with State Arbitrazh Courts

A Cooperation Agreement between the Chamber of Commerce and Industry of the Russian Federation and the Supreme Arbitrah Court of the Russian Federation was concluded on April 8, 2003. The parties agreed to cooperate in protecting the rights and legitimate interest of businessmen, developing and promoting civilized ways of commercial dispute resolution, and forming a body of arbitral jurors for Russian state arbitrah courts. They also agreed to exchange arbitration practice sources and information on international agreements and foreign legislation in force.

Seminars and conferences on international arbitration are held for lawyers and businessmen all over Russia under this agreement. They are attended by heads and judges of the Supreme Arbitrazh Court of the Russian Federation, federal arbitrazh courts of Russian Federation districts and state arbitrazh courts of Russian Federation constituent entities, heads of departments of the CCI of Russia and regional CCIs, and experts of arbitral bodies within the CCI system.

To achieve uniformity in the enforcement and appeal of ICAC decisions, ICAC representatives will sit on the scientific advisory boards attached to the Supreme Arbitrazh Court of the Russian Federation and the Moscow District Federal Arbitrazh Court.

In 2004, the CCI of Russia in collaboration with ICAC Presidium representatives drew up an opinion on draft reviews of the practices of the above-mentioned courts in appealing and enforcing arbitral decisions, which was sent to the Supreme Arbitrazh Court of the Russian Federation and the Moscow District Federal Arbitrazh Court.

Representatives of the Supreme Arbitrazh Court of the Russian Federation as part of an CCI working group took an active part in elaborating a draft federal law “On Mediated Conciliation Procedures (Mediation)”.

In furtherance of the Cooperation Agreement Between the Supreme Arbitrazh Court of the Russian Federation and the Chamber of Commerce and Industry of the Russian Federation, a Cooperation Agreement between the Chamber of Commerce and Industry of the Russian Federation and the Moscow District Federal Arbitrazh Court was concluded on February 25, 2005.

The working group of the Chamber of Commerce and Industry of the Russian Federation and the Supreme Arbitration Court of the Russian Federation was established in 2008. Within that working group the issues of interaction of state courts and arbitration tribunals are discussed, recommendations for uniform enforcement, removing obstacles, arising from issuance of the writ on bases of arbitration tribunals' awards are worked out.

One of the working areas of the group is the interaction of expanding the allowable use of electronic tools and materials in the proceedings of disputes, including the use of Internet technologies.
