How the ICAC performed in 2009

International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation activities in 2009

During the 2009 the ICAC registered 250 new claims from companies of 45 countries of the world.

The origin and the number of parties were as follows: Ukraine — 36; Germany — 17; Kazakhstan — 14; United Kingdom, Cyprus — on 13; Italy — 12; Belarus — 10; Turkey — 7; China, Serbia — on 6; Uzbekistan — 5; the Netherlands, Panama, Poland, Switzerland, USA — on 4; Armenia, Finland, Vietnam — on 3; Azerbaijan, Belize, Canada, Estonia, Japan, Kyrgyzstan, Korea, Liechtenstein, Moldova, Tajikistan, — on 2; Australia, Austria, Belgium, Israel, India, Latvia, Luxembourg, Malta, Marshall Islands, Singapore, Slovakia, Turkmenistan, SAR, UAE — on 1.

Companies from Western and Eastern Europe countries prevailed among foreign parties — 86 companies altogether, CIS was on the second place — 77 companies altogether.

Russian companies were involved in 231 disputes. Also ICAC settled 18 disputes, in which both parties were non-Russian companies.

An analysis of the subject-matter of disputes shows that during 2009, like in the years before, majority of disputes related to international sale of goods — 149 disputes (60 %).

The rest of cases were concerned with the following relations:

  • 30 (12,1%) work and services contracts;
  • 20 building and construction (8 %);
  • 15 carriage and transportation (6,1%);
  • 14 loan and credit agreements (5,6%);
  • 6 disputes from commercial representation and agency (2,5%).

Disputes from other groups of international transactions (lease, insurance, security transactions, bank guarantee and other) amounted to 0,4-2,5% per each group or about 5,7% altogether.
